SP0442, LD1428 - CHANGES TO MAINE'S STORAGE STATUTE ARE NOW LAW!

Pursuant to the Constitution of Maine, Article IV, Part Third, Section 16, the general effective date for nonemergency laws passed in the First Regular Session of the 125th Legislature is Wednesday, September 28, 2011. We celebrate our changes to our lien law SP0442, LD 1428, item 1, 125th Maine State Legislature An Act to Amend the Laws Governing Self-service Storage in the State. We have much to be excited about-we have made changes to our law that enable us to do business in a way that is less cumbersome, will save us money, and will make it easier to comply. Many other states are seeking some of the same changes that we have made and most are having success. Our success is huge considering  we have made far more changes than any other state has sought. SSA attorney, Scott Zucker, commented that our new law is “the storage operator’s dream”. MeSSA will be offering a new lease template and operational guideline incorporating these changes and the changes from the previous legislative session regarding third party personal documents in storage. This template/guideline has been drawn up by attorney Scott Zucker. It will be FREE to MeSSA members and will be available to non-members for a fee.

MeSSA's 2011 ANNUAL CONFERENCE REVIEW

The two words most often used by attendees to describe the Maine Self-Storage Association (MeSSA)’s 2011 annual conference on June 9th and 10th were “fun” and “educational” (and not necessarily in that order). The conference was open to both members and non-members alike. Members took advantage of MeSSA’s special pricing – the first attendee from each member facility was able to attend for free. This was especially enticing as the conference was held at Hollywood Slots in Bangor.

The night of the 9th featured a vendor-sponsored cocktail and appetizer reception from 6 to 8pm. This was the perfect opportunity for attendees to mingle and network with other facility operators and managers as well as with industry vendors. Afterward, most of the attendees took advantage of the venue and tried their luck at the slots. A large number of people took advantage of the social atmosphere to continue to mingle and talk. Most of the attendees who had to travel to the event stayed in the hotel, taking advantage of the comfortable accommodations and special event pricing.

A breakfast buffet, included in the registration, was set up from 8 to 9am for attendees. Tim Dietz, Self Storage Association Sr. VP-Communications and Government Relations, opened the day with a state of the industry talk, touching specifically on the many state associations going through the process of updating their lien laws. Dietz specifically commended MeSSA on the changes to Maine’s self-storage statute, making enforcing liens on delinquent units simpler, more economical, and efficient.

After Dietz, MeSSA President and Vice-President Rhonda Hallett Pope and Mark Adler spoke in more detail about the changes to the Maine law as well explaining the benefits of membership in the association.

Michael Grant from the Maine Emergency Management Agency gave a presentation that was informative and entertaining, not only going through a PowerPoint presentation, but also using personal experiences and amusing anecdotes to spice up the subject matter. Grant may have frightened a few attendees into paying close attention by speaking about explosives, weapons, and clandestine drug labs.  

Can-Am Building Systems representative Tim Noonan gave a presentation on the importance of facility maintenance and curb appeal, and the direct effect they have on new rentals and customer retention. Noonan outlined some simple yet affective ways to keep facilities in tip-top shape.

Attendees were treated to lunch in Hollywood Slot’s world famous “Epic Buffet”. The choices were endless and no two plates contained the same combination of edibles. Dessert was sinful and more than one comment was made about the future effects of the meal on people’s waistlines.

After lunch, Connie Neville, from Sperry Van Ness Commercial Real Estate Advisors spoke on facility valuations, cap rates, and purchases and sales. Neville provided this information in a way that even the most financial-phobic of the group were able to understand and benefit from it.

Paul Maglio, of Storage Auction Solutions was the conference key note speaker. Maglio talked about the auction process and how the rash of reality television shows featuring storage auctions such as “Storage Wars” and “Auction Hunters” have affected the storage industry. Paul also regaled the attendees with stories “from the trenches” of auctions as well as talking about filming an episode of “Auction Hunters”.

The day was wrapped up with the awarding of door prizes and many a hearty “thank you” to all those who contributed to the success of the event.

Based on feedback from attendees in regard to the success of the conference, the MeSSA Board of Director’s has decided to schedule the 2012 annual conference for the same venue, to be held on June 14th and 15th.

Ring in the new year with your fellow storage professionals at this fun member meeting on January 19, 2012!

 

This is definitely a “not to miss” meeting. We will meet from 5:30 to 6:00 for networking, followed by dinner at the Muddy Rudder Restaurant in Yarmouth. As usual, we will order off the Muddy Rudder’s extensive menu (dinner on your own tab). There is something for everyone’s palate! This meeting is open to non-member self storage facility owners and operators. With all of the recent self storage law changes and our up-coming annual conference (FREE for members), now is a great time to get involved!

 

Here is your assignment: when it is your turn to introduce yourself, please share a helpful tip with everyone. This will be a great opportunity to learn something new from each other. Some ideas would be tips on marketing, do-it-yourself repairs, social media, online web directories, maintenance, a favorite product, community service projects, networking, phone sales, finding employees, safety and security, etc. The possibilities are endless. SP 577, LD 1499: Is Now Law!

Maine Legislative Document 1499, “An Act to Protect Confidential Consumer Records in Self-Service Storage Facilities,” has been passed by the Business Research and Economic Development Committee. The Maine Self Storage Association (MeSSA) has worked with the state legislature to craft and amend this new bill pertaining to the handling of third-party personal records in self-storage.
 
After a recent review of the bill, the BRED Committee asked MeSSA to work with the Bureau of Consumer Credit Protection to agree on appropriate language regarding self-storage operation and leases as well as the association’s stance on the bill. After some legislators expressed concern about the bill, amendments were made, after which it passed the committee unanimously. The outcome of this bill was much more favorable than we had hoped for. MeSSA appreciates the help from two legislators in particular with regard to the last minute changes: Representative Jayne Crosby Giles and Representative Susan M.W. Austin. We also appreciate the help and guidance of our lobbyist, Ron Collins. The bill was signed by Gov. Baldacci on March 22, 2010 and is now in effect. MeSSA members have access to this new language in the "MEMBERS ONLY" section of the website.
